Multidistrict litigation, also commonly referred to as an MDL, is a type of legal proceeding that is intended to assist federal courts in efficiently handling multiple lawsuits that are related, but filed by different parties in different jurisdictions. The federal multidistrict litigation statute, 28 U.S.C. § 1407, specifically allows federal civil lawsuits to be temporarily transferred to one or more district courts for pretrial coordination or consolidation. Multidistrict litigation’s fundamental purpose is to provide a streamlined method of managing complicated cases, especially when numerous federal lawsuits have been filed in various district courts by separate plaintiffs, but concern the same defendant and/or very similar legal issues. Nevertheless, each plaintiff can still maintain their lawsuit and compensation is determined separately for each case. MDLs are typically formed by the Judicial Panel on Multidistrict Litigation (JPML).

The Judicial Panel on Multidistrict Litigation is a panel formed by seven federal district court and appellate court judges that are all from different parts of the country. The JPML is tasked with determining whether court cases in different districts are similar enough to collectively participate in the preliminary phases of civil litigation. When the panel concludes that multiple cases share common questions of fact, the JPML can assign the lawsuits to a specific court for joint pretrial proceedings. As a result, various cases about the same matter are consolidated into a single MDL and overseen by a single judge. When the Judicial Panel on Multidistrict Litigation decides to consolidate and assign cases to a judge, all of the other federal lawsuits subject to the multidistrict litigation will then be transferred from their original courts (where each plaintiff filed their claims) to the MDL court for discovery and court proceedings.

Multidistrict litigation is typically applied by the federal court system to conserve resources, save time and, most importantly, procure consistent rulings by the court for separate cases that contain remarkably similar issues. MDLs allow for each plaintiff’s individual needs to be dealt with while still enjoying collective advantages, such as combining resources that may be necessary to take on massive, influential corporations with practically unlimited resources to be used for their defenses.
For instance, when a considerable number of victims pursue legal actions after suffering harm from the same defective product, such as Zantac or hernia mesh, their lawsuits may be consolidated to a single federal district court.
The single court will then manage all discovery and pretrial proceedings. The district judge supervising the multidistrict litigation will evolve into an expert on the case and be able to increase the effectiveness of rulings that will apply to all pertinent claims. This can also accelerate the course of litigation significantly by only requiring witnesses and defendants to be deposed once instead of over and over again by each of the plaintiffs. The same depositions, expert medical testimony and documents can then be used in each lawsuit, which enables plaintiff law firms to band together to review massive amounts of documents collectively. The cases are then sent back to the original courts to proceed with their separate trials.
