Multidistrict litigation, also commonly referred to as an MDL, is a type of legal proceeding that is intended to assist federal courts in efficiently handling multiple lawsuits that are related, but filed by different parties in different jurisdictions. The federal multidistrict litigation statute, 28 U.S.C. § 1407, specifically allows federal civil lawsuits to be temporarily transferred to one or more district courts for pretrial coordination or consolidation. How Does The Judicial Panel On Multidistrict Litigation Work? People Talking

The Judicial Panel on Multidistrict Litigation is a panel formed by seven federal district court and appellate court judges that are all from different parts of the country. The JPML is tasked with determining whether court cases in different districts are similar enough to collectively participate in the preliminary phases of civil litigation. When the panel concludes that multiple cases share common questions of fact, the JPML can assign the lawsuits to a specific court for joint pretrial proceedings. As a result, various cases about the same matter are consolidated into a single MDL and overseen by a single judge. When the Judicial Panel on Multidistrict Litigation decides to consolidate and assign cases to a judge, all of the other federal lawsuits subject to the multidistrict litigation will then be transferred from their original courts (where each plaintiff filed their claims) to the MDL court for discovery and court proceedings.
