Amputation Accident FAQS

Of the 328 million individuals currently living in the United States, nearly 2 million have suffered a loss of limb due to either an accident or disease-related trauma. Roughly 185,000 individuals receive amputations in the United States every year. The three leading causes of amputations are trauma, cancer, and vascular disease (diabetes or peripheral arterial disease). An examination conducted by the Amputee-Coalition determined that there was a 3.6% increase in the number of amputations being performed across the United States. This upward trend can be alarming for many individuals, particularly for those who have personal experience with amputation. Knowing what to expect in the event of an amputation is the first step in preparing yourself for the future.

Any accident that results in an amputation leaves a lasting impact. Amputation Accident Statistics

In a single year, 94% of the total amputations performed across the United States involved the lower-limbs. Toes were the most frequently amputated, with surgery below the knee being the second most common. By contrast, upper-limb amputations total roughly 5% of the percentage of yearly amputations. Of these, fingers are the most commonly lost. Individuals between the ages of 45-84 amount for most amputation surgeries seen in the United States.

An important concern for every individual is what sort of accidents can lead to the need for an amputation. Amputation accidents can occur anywhere. Whether mowing the lawn, preparing a meal, driving a car, operating machinery at work, or even taking a walk, there is potential that an accident might take place severe enough to necessitate amputation of limbs. For more detailed information on amputations, their causes, and medical complications, refer to our amputation injury webpage.

In the Event of Severe Injury

An accident or injury that results in the loss of a limb can be frightening for those involved. In the event of an injury severe enough to merit amputation, there are both immediate and secondary action steps that can be taken. First, the injured party should receive immediate medical attention:

  1. Immediately call 911;
  2. Determine that the patient is breathing, calm, and comfortable. Be extremely careful with the head and neck so as not to cause any further injuries;
  3. As best as is possible, control the injured party’s bleeding by wrapping the injury with a bandage, cloth, or sterile medical dressing; and
  4. In the event of loss of limb, wrap the severed limb in a moist cloth and place it into a water-tight container such as a plastic bag or Tupperware. If possible, use ice packs, never ice, to help preserve the limb while it is transported to the hospital.

Once necessary medical treatment has been administered, your next steps as either the injured party or as a loved one are to attain legal representation. Every day Jed Dietrich, Esq., a distinguished member of the Multi-Million Dollar Advocates Forum, and his top rated team of Buffalo, New York amputation accident attorneys strive to provide the highest level of injury service. Legal Questions

Amputations are extremely expensive operations. The average cost of a lower-limb amputation is greater than $500,000, and the cost of a prosthetic device can be as much as $91,000. If amputation resulted from an accident, there are legal steps that can be taken to receive compensation for the lost limb.

In New York State, a personal injury lawsuit must be filed quickly, as is stipulated in Article 2: Section 214 of New York State Consolidated Laws. The value of your amputation lawsuit settlement depends on several factors, including the amount of current and future income lost as a result of the amputation, the medical bills, and the emotional and physical aftereffects of the injury. While there is no amount of money that can replace a limb, a settlement can significantly ease the burden of medical bills, living expenses, and the cost of prosthetics.
