Child Drowning Overview

The Centers for Disease Control and Prevention (CDC) estimate that, in the United States, approximately ten people die from unintentional drowning each day, and there are approximately 3,536 fatal drownings, that are not related to boating, every year. The CDC provides the following facts and figures on drowning:

  1. Two of the ten drowning deaths that occur in the U.S. each day involve children under the age of fourteen;
  2. Children between the ages of one and four have the highest drowning rate;
  3. Drowning is the second leading cause of death in children between the ages of one and four, following birth defects;
  4. Most drowning victims between the ages of one and four drown in home swimming pools; and
  5. Fatal drowning is the second leading cause of unintentional injury-related death in children between the ages of one and fourteen, behind motor vehicle accidents.

Swimming is a risky activity, and children should never swim without the supervision of an adult who is a capable swimmer. Drowning can occur anywhere from home pools to community pools or beaches with a lifeguard present. Even children who are strong swimmers are at risk of drowning.

Drowning is not always fatal. While deaths from drowning do frequently occur, the CDC estimates that “for every child who dies from drowning, another five receive emergency department care for nonfatal submersion injuries.” Half of those treated for drowning must remain in the hospital for further treatment. Nonfatal submersion can cause serious harm. The most common type of injury associated with nonfatal submersion is brain damage, specifically due to a lack of oxygen to the brain. Brain damage can lead to the following long-term issues:

  1. Learning disabilities;
  2. Loss of mobility;
  3. Memory loss; and
  4. A permanent vegetative state.

All of these long-term injuries can negatively alter a child’s way of life and can have a devastating impact on the child’s family. Whether a drowning incident results in death or a serious long-term injury, it often ends life as the family knew it.

If your family has suffered the devastation of a child drowning accident, you might be entitled to compensation. Drowning Prevention and Liability

Drowning is preventable. Homeowners, parents, and lifeguards can take careful steps to prevent drowning accidents. Homeowners with pools in New York State must ensure no child suffers a drowning incident on their property. In order to do so, the CDC recommends that they:

  1. Ensure there is a fence or barrier at least four feet high around any inground pool area or that the walls of an above ground pool are at least four feet high;
  2. Ensure that the fence around the pool area locks;
  3. Ensure that the gap between the fence and the ground is no more than two inches tall; and
  4. Ensure that ladders or steps are removed from an above ground pool when the pool is not in use.

A responsible adult who is a capable swimmer should be present whenever children are swimming in a backyard pool. Before allowing children to swim in your pool, you should know their capabilities as swimmers.

Additional safety features, like retractable pool covers, pool alarms, and self-closing gates, are also recommended to prevent drowning. Failure to adhere to the preventative measures above could put a homeowner at risk of having a child from outside of their home, such as a neighbor, enter their backyard and intentionally or unintentionally enter the pool. If a homeowner fails to take appropriate measures to prevent a child from drowning in their pool, that homeowner could be held liable for the accident. If your family has experienced a child drowning accident, you might be entitled to compensation for both short and long-term medical bills, pain and suffering, and wrongful death.

If your child’s drowning accident resulted from the negligence of another homeowner, you might be entitled to compensation.
