Niagara Falls residents are raising the alarm after radioactive waste was found in the backyards of at least 120 homes throughout the region.

Earlier this year, New York State Department of Health Commissioner James McDonald issued a statement acknowledging the severity of the situation.

“What we are dealing with here, which I think is very concerning which is chronic, long-term exposure, because that is really what increases the risk for cancer and other health concerns, so we are taking this very seriously; that is why my team is working this, really, quite frankly, night and day on this thing,” McDonald said.

New York law is clear.

If you or a loved one has been seriously injured in a car accident that was not your fault, you have a legal right to take action against the person or party who caused your crash. However, where your no-fault policy will often pay benefits without asking too many questions, the courts are another matter. Judges and juries care about liability, because liability determines who, if anyone, should have to pay your damages. This could be you, another driver, or somebody else altogether.

A lying defendant can make an already-difficult process more frustrating.

You cannot always avoid adjusters after a car accident, but that does not mean you should ever let your guard down while talking to the defendant’s insurance company.

Here is what you need to know about:

The Insurance Company’s Motivations

If you have been injured in an accident that was not your fault, the prospect of spending months in court for an uncertain outcome could seem like a bad investment. Personal injury cases can take months to resolve, sometimes even years.

However, filing a lawsuit does not always mean committing to trial.

In fact, most lawsuits are never tried before a judge and jury. Instead, they are often resolved through negotiation. Settlements are not reached overnight, but compromise is sometimes preferable to the risk of a full-blown trial.

Filing a personal injury lawsuit is often a big decision.

If you are in a position to consider taking legal action, there is probably a good reason for it. However, not every accident is worth the time, effort, and energy. If you were involved in a fender-bender that was not your fault and need help with car repairs, you should not have to take on the expense yourself, but, it is often more prudent to work with your insurance than to spend months litigating a property damage case with an uncertain outcome.

This calculus changes considerably when and where serious injuries are involved.

You should not feel bound to pay the price for another person’s mistake.

In New York, accident victims have a legal right to file a claim for compensation against the person who caused their injuries. You can still sue even if you were partly to blame for the accident, and you do not have to have a rock-solid case to talk to a lawyer and schedule a consultation.

However, filing a personal injury lawsuit is often much easier than fighting one, let alone winning and walking away with enough money to begin building back.

Few people are ever fully prepared to file a lawsuit, let alone a wrongful death claim.

Losing a loved one, after all, entails much more than grief. Grief alone is often enough to make everyday life unrecognizable. Beyond emotional hardship, losing a loved one also means losing a critical pillar of support. Funerals can cost substantial amounts of money, and reconfiguring your finances to account for a loss of income could make an unwelcome change seem inevitable.

However, no amount of money can ever compensate for the loss of a parent, spouse, or child; however, filing a product liability lawsuit may serve a greater purpose. Negotiating a settlement could provide a means to guarantee your financial stability or present an opportunity to ensure that a negligent company is compelled to reform, thereby protecting others from enduring the unthinkable.

You should never have to pay for an accident that was not your fault, but filing a personal injury lawsuit is not always straightforward.

Suppose you have been involved in a car crash or a slip-and-fall accident. In that case, you may already have a rough idea of what to do next: call the police or ask for a manager, contact the at-fault party’s insurance company, and then reach out to an attorney if you need help obtaining evidence or negotiating a better settlement.

But what happens if you have been injured by a product that you purchased?

Serious accidents often lead to serious injuries.

A variety of factors determine the severity of an injury. These factors can, in turn, influence the course and length of your recovery. If you have sustained a fracture, a broken bone, or damage to a joint, there is a good chance treatment will entail more than a one-and-done visit to the emergency room. You may even have to sit down for a consultation with an orthopedic surgeon or other medical specialist.

Orthopedic Doctors And Your Personal Injury Claim

Serious accidents can have life-altering repercussions.

If you have been injured in an accident that was not your fault, filing an insurance claim and talking to a personal injury lawyer is often just the beginning of a long, drawn-out process.

Even if you are confident that someday you will be fit enough and ready enough to resume your ordinary routine, traumatic injuries have a bad habit of hounding survivors for much longer than most anyone would anticipate. Physical pain can be both debilitating and disabling. In some cases, it could persist for years after an accident, serving as an ever-present reminder of a time you would rather move past than be reminded of every day.
