In the not-so-distant past, Tesla took a fairly straightforward approach to most legal claims involving Autopilot.

Even in cases where Autopilot had obviously fallen flat, Tesla’s attorneys would point to the fine print. In the world of Tesla’s corporate logic, drivers who pay thousands of dollars for an Autopilot subscription should know better than to trust it. Since Autopilot is not a full self-driving system, the argument goes, motorists must remain ready to retake the wheel at a moment’s notice. If drivers do not have time to react, the fault is on them for being inattentive.

How Two Cases Could Affect Your Tesla Autopilot LawsuitTesla Settles a California Family’s Lawsuit

In September 2025, Tesla agreed to settle a wrongful death claim filed on behalf of the estate of a 15-year-old California boy.

The lawsuit, originally filed in Alameda County Superior Court, recounted how Jovani Maldonado and his father had been driving along the interstate in a pick-up truck when they were suddenly rear-ended by a Tesla. The force of the impact threw the boy through the vehicle; he died from his injuries shortly afterward.

Attorneys for the Maldonado estate noted that the driver of the Tesla, who was also named as a defendant in the lawsuit, had been “passively sitting” in his vehicle with Autopilot mode turned on. He did not have his hands on the steering wheel for at least 14 seconds before the crash.

The terms of the settlement agreement are confidential, but the Maldonado family’s lawsuit accused Tesla’s Autopilot of being inherently defective.

A Florida Judge Upholds a $243 Million Verdict Against Tesla

Tesla recently experienced one of its first major legal defeats in an Autopilot lawsuit.

In February 2026, a federal judge in Florida rejected the company’s request to overturn a $243 million verdict. The case relates to an April 25, 2019, accident in Key Largo, Florida. At the time of the accident, George McGee was driving a 2019 Tesla Model S through an intersection when he dropped his cell phone. McGee had Autopilot enabled and believed that it would keep him safe, but the vehicle crashed into an SUV, killing 22-year-old Naibel Benavides Leon and leaving her boyfriend, Dillon Angulo, severely injured.

The jury ultimately found Tesla 33% liable for the accident under Florida’s comparative liability law. Tesla protested the initial verdict, arguing that automobile makers “do not insure the world against harms caused by reckless drivers.” In response, U.S. District Judge Beth Bloom said that the evidence presented at trial “more than supports” the jury’s verdict.

Do You Have a Case Against Tesla?

Car-makers have a responsibility to ensure that the products they sell are safe to use.

Autopilot is marketed as a driver-assistance system that can take over many of a vehicle’s essential functions. You may be expected to remain alert, but the premise of Autopilot all but requires that you place a certain amount of trust in your Tesla’s technological integrity. If and when Autopilot makes a miscalculation, you should not be left paying out-of-pocket for a multibillion-dollar company’s mistake.

If you or a loved one has been injured in an Autopilot accident that was not your fault, you could be entitled to significant compensation. However, in order to sue Tesla, you must typically be able to establish that:

  1. You were injured in an accident involving an Autopilot-equipped Tesla;
  2. The Autopilot was in some way defective;
  3. The Autopilot-related defect was the direct or proximate cause of your injury; and
  4. You have sustained serious injuries and other legal damages as a result of your accident.

Meeting these criteria might seem simple, but it is often anything but. Tesla may be more willing to settle personal injury claims than it was in years past, but it is still a business. If it can find a way to offload liability for your accident, it will even mean blaming you for a crash that was unequivocally caused by Autopilot.

Do not take chances with your rights: if you think you could have a case, contact an experienced Tesla autopilot injury lawyer today.

Damages in a Tesla Autopilot Lawsuit

Damages are compensation for the losses and hardship you have experienced as a result of an accident. Your damages are unique to your case, but they could include relief for:

  1. Your existing medical bills;
  2. The costs of future or anticipated care;
  3. Physical therapy;
  4. Lost income from work;
  5. Diminished earning potential;
  6. Pain and suffering;
  7. Emotional distress;
  8. Loss of enjoyment;
  9. Disfigurement, including scarring; and
  10. Wrongful death.

New York law does not cap damages in most product liability claims. In other words, you could recover as much money as you need to reclaim your financial independence and begin building back. However, you cannot always afford to wait too long before contacting a lawyer. If you do not act fast, critical evidence could be compromised, or the state statute of limitations could lapse. If this happens, you could lose your rights.
