Syracuse, New York: Dupixent LawsuitsDupixent is a biologic medication that is used to treat conditions like eczema and asthma. It works by binding to certain protein receptors, then blocking critical immune system pathways. This can help reduce the kind of inflammation that aggravates atopic dermatitis; it can also provide relief for patients with asthma by reducing pressure in and around the airway.

However, taking Dupixent could introduce a profound and previously unrecognized risk.

A growing body of research now indicates that people who use Dupixent are significantly more likely to be diagnosed with cutaneous T-cell lymphoma than people who have never taken this medication. Nobody understands exactly how or why Dupixent might contribute to this rare form of cancer, but study after study has already established a tentative link.

Syracuse, New York: Dupixent Lawsuits

Under state and federal law, pharmaceutical companies have a legal responsibility to warn patients about potential medication side effects and complications. In the absence of any clear warning labels, people who take Dupixent may not realize that the skin conditions they are treating are actually cancerous, making it more difficult to obtain a diagnosis and receive the right treatment.

You should not have to pay the price for a pharmaceutical company’s oversight.

Dupixent And CTCL

Scientists believe that Dupixent could also cause, exacerbate, or contribute to cutaneous T-cell lymphoma. Cutaneous T-cell lymphoma, or CTCL, is a rare type of cancer. Its most common subtypes include:

  1. Dupixent And CTCLMycosis fungoides is a common subtype of cutaneous T-cell lymphoma that primarily affects the skin.
  2. Sezary syndrome is a rarer but more aggressive subtype of CTCL that can affect both the skin and the blood.

Nobody understands exactly how or why Dupixent interacts with cancer. One theory relates to the overlap in symptoms between CTCL and conditions like eczema. Early-stage cutaneous T-cell lymphoma can, for instance, trigger isolated skin abnormalities, like raised, scaly, or itchy skin. These symptoms are very vague and can be easily misdiagnosed as dermatitis. By suppressing symptoms, Dupixent could make it considerably more difficult to obtain an accurate diagnosis.

Other theories suggest that Dupixent could reduce other immune system functions, making it harder for the body to surveil and control T-cell mutations believed to cause cancer. It is also possible that, by blocking immune pathways, Dupixent can effectively “accelerate” CTCL, making the disease progress much faster than it otherwise would.

The Requirements For Filing A Dupixent Cancer Lawsuit

You could be entitled to file a lawsuit against Sanofi, Regeneron, or another pharmaceutical company if you meet certain requirements. In general, you must be prepared to establish the following:

  1. You took Dupixent for eczema, asthma, or another approved use;
  2. You were diagnosed with cutaneous T-cell lymphoma after taking Dupixent; and
  3. You were not diagnosed with Hodgkin’s lymphoma, non-Hodgkin lymphoma, or a similar condition before starting Dupixent.

The research establishing a relationship between Dupixent and cutaneous T-cell lymphoma is recent, which means that most patients have not had a chance to file claims, negotiate settlements, or take their cases to trial. The requirements for filing and winning a lawsuit are not set in stone, and there is a chance you could have standing to sue even if you do not meet all of the above conditions.

Evidence In A Dupixent Cancer Claim

In order to win a personal injury claim against a pharmaceutical company, you will need evidence to show that your CTCL diagnosis was most likely caused by Dupixent. This evidence could include, but is not limited to, the following:

  1. Prescriptions for Dupixent or a generic variant;
  2. Documentation showing that you were legally prescribed Dupixent;
  3. Doctor’s notes or visitation records indicating that you took Dupixent regularly and in accordance with your provider’s instructions;
  4. A diagnosis of cutaneous T-cell lymphoma; and
  5. Any other medical records that you received before, during, or after treatment.

In all probability, you will need more evidence than this to win a lawsuit.

After all, lawsuits against pharmaceutical companies are often hard-fought and contingent on the availability of high-quality scientific evidence. In a typical case, this might include correspondence obtained through discovery, reports from scientific journals and medical research publications, and testimony from expert witnesses. However, you do not need to have every possible piece of evidence ready before filing a lawsuit. Your Dupixent injury lawyer will help you review the evidence you already have and determine what evidence you will likely need when it comes time to take your claim to court.

Your Potential Compensation In A Dupixent CTCL Lawsuit

Your damages are compensation for the losses you have suffered as a result of an injury.

In New York, damages tend to fall into either of the following categories:

  1. Economic damages. Economic damages, or “special damages,” compensate verifiable financial loss. Your economic damages could include compensation for your hospital bills, the costs of anticipated care like chemotherapy and reconstructive surgery, and the income you lost from work while in recovery.
  2. Non-economic damages. Non-economic damages, sometimes called “general damages,” compensate intangible forms of hardship. They could include money for emotional pain and suffering, physical pain and suffering, loss of enjoyment, and disfigurement.

Unlike many other states, New York does not cap damages in most personal injury claims. This means that you could receive as much money as you need to start rebuilding. However, you should not wait too long to take action. If you wait, the statute of limitations applicable to your case could lapse. Once this happens, you could lose all your rights to a fair recovery.
