Drowning Accidents in Rochester

Jed Dietrich, Esq., is Recognized as A Best Lawyer in America, and He Has Dedicated His Career to Combating Negligence and Injustice. If You Were Hurt or Lost a Loved One After a Rochester Drowning Accident, You Could Be Eligible for Compensation.

Drowning deaths are a tragically common occurrence across the country. Each day, an estimated 11 people pass away in drowning accidents. Although people of all ages are at risk of drowning, the federal Centers for Disease Control and Prevention has found that children between the ages of 1 and 4 are the most likely to suffer death or serious injury.

Drowning accidents are unique, and circumstances vary across incidents. If you or a loved one have been injured or lost someone in a drowning accident, you could be entitled to significant financial compensation. Although no amount of money will replace a loved one or take away your pain, an insurance settlement or personal injury lawsuit could serve as a powerful deterrent to negligent homeowners and businesses, helping ensure that other families are afforded better protection.

The Dietrich Law Firm P.C. is committed to providing our clients across Rochester and Western New York with the highest level of personal injury service. Our dedicated team of attorneys has years of experience representing people who have been injured by egregious acts of negligence. Since our founding, we have secured more than $175 million in damages—money that our clients could use to pay medical bills, lay a loved one to rest, and fund memorial trusts. We could help you, too. How Drowning Accidents Happen

People often equate "drowning" with "death." However, the scientific definition of the term is nuanced, and you might be surprised to learn that many drowning accidents are not fatal. Researchers define drowning as "a process of experiencing respiratory impairment from submersion/immersion in a liquid." Expressed differently, drowning happens when someone cannot properly breathe because their lungs have been partially or wholly filled with a liquid. The Centers for Disease Control and Prevention recently released statistics showing that an estimated 3,960 people die from drowning each year, while an estimated 8,080 non-fatal drownings occur annually. Of these 8,080 non-fatal drownings, approximately 40% require emergency treatment or intensive care.

Epidemiologists have identified the following "risk factors" for drowning:

  1. Age: People ages 17 and under are at the highest risk of drowning. In fact, the CDC believes that drowning is the second-leading cause of unintentional injury death among children.
  2. Gender: Men and boys are the most likely to drown, with epidemiologists finding that up to 75% of all drowning victims are male.
  3. Location: The risk of drowning in a small body of water is about the same as drowning in a large body of water. However, the vast majority of drowning incidents—up to 84%—take place in rural settings.
  4. Swimming Ability: Most people who drown either cannot swim or have limited swimming ability.
  5. Time: An estimated 95% of all drownings take place during the day.
  6. Supervision: Since young children are the most likely age group to suffer drowning deaths or drowning injuries, a lack of supervision often correlates to increased drowning rates.

Other factors also play a role in drownings. For example, alcohol use could play a role in anywhere between 10 and 30% of adult drowning deaths. Regardless of how drowning happens, it is a serious public health risk to Americans of all ages. Some activists consider drowning an "epidemic."

If you have lost a loved one to drowning, you could file an insurance claim or personal injury lawsuit to recover your loved one's medical expenses and burial costs. However, you will have to act fast: New York has a strict statute of limitations on wrongful death lawsuits. If you wait too long to take action, you could lose your chance at justice.

The Dietrich Law Firm P.C. was established to help New York families overcome obstacles to justice. If another person's negligence caused your loved one to suffer a drowning death or drowning injury, we could gather the evidence needed to prove their liability to an insurance company, a judge, or a jury. Please call us today at 585-939-3939 to discuss your potential strategies for legal recourse.

Where Drowning Accidents Most Frequently Occur

Statistics show that drowning accidents can happen almost anywhere there is water. However, people of different ages face markedly different risks. For infants and children under the age of 4, drowning most often occurs in:

  1. Bathtubs;
  2. Buckets;
  3. Toilets;
  4. Home swimming pools;
  5. Hot tubs; and
  6. Spas.

For older children and adults, drowning is more likely to occur in:

  1. Swimming pools;
  2. Lakes;
  3. Rivers; and
  4. Oceans.

People of all ages have an elevated risk of drowning when they are in boats. In one recent incident, a 26-year-old Rochester man drowned in Lake Ontario after exiting a watercraft. Similar drowning-type accidents account for most boating-related deaths in the United States.

When people ignore the law and the precepts of common sense, they put other people in danger. Municipal swimming pools, watersports businesses, and even private homeowners are all legally obligated to take measures to minimize the risk of accidental drowning. The New York Residential Property Code, for instance, directs homeowners to construct barriers around indoor and outdoor swimming pools. You, and your family, should never have to bear the burden of another person's bad decision—especially when their negligence causes you, or a loved one, serious injury. Jed Dietrich, Esq., could help you obtain the legal recovery you need to begin putting your life back together after a tragic and preventable drowning incident.
