Philips Respironics Recently, Philips Respironics issued a voluntary recall of various mechanical ventilators, including the Continuous Positive Airway Pressure (CPAP) and Bi-level Positive Airway Pressure (BiPAP), due to serious potential health risks. The polyester-based polyurethane (PE-PUR) foam that was used to reduce sound and vibration in the recalled machines was found to degrade and break down into tiny particles. Upon entering the device’s airpath, these particles can easily be inhaled or swallowed. This unnecessarily exposes users to hazardous toxins that could cause lung cancer, kidney cancer, and liver cancer. Philips acknowledged that inhalation and ingestion of the polyester-based polyurethane foam could lead to irreparable and life-threatening injuries. Other potential health risks identified included chest pressure, sinus infections, chronic coughing, toxic exposure, dizziness, headaches, and pulmonary fibrosis.

The U.S. Food and Drug Administration’s (FDA) alert concerning the recalled devices has led to a surge of new lawsuits against Philips. If you have used a Philips sleep apnea device and suffered any injuries or health complications, you may be entitled to receive monetary compensation through a product liability lawsuit. While no amount of money can erase your pain and suffering, compensation can help you obtain the necessary medical treatment and ensure that justice is rendered. You may be able to obtain damages for all past and future medical expenses, rehabilitation, lost wages from missing work, reduced future earning capacity, pain and suffering, loss of consortium, loss of enjoyment, and much more.

Recommendations For Those With Recalled Philips Devices

Philips cautioned users of mechanical ventilators not to discontinue or alter their prescribed treatments before first consulting with their physician to determine any necessary measures to minimize adverse impacts. Your doctor will establish a suitable treatment based on the severity of your condition, which may include:

  1. Completely stopping all use of your device;
  2. Using another comparable ventilator that has not been recalled;
  3. If it can be determined that the benefits outweigh the risks, continue using your recalled device;
  4. Applying alternative treatments for sleep apnea, such as sports mouth guards, orthodontic retainers, or positional therapy;
  5. Beginning long-term sleeping disorder therapies, like avoiding alcohol, dieting, exercising, or quitting smoking;
  6. Considering surgical options to treat sleep apnea by removing, repositioning, or stiffening tissues around your throat;
  7. Following Philips’s suggested cleaning and replacement guidelines for your device and accessories; and
  8. Registering your device on Philips Respironics’ recall website to be notified of all device-related updates.

Degradation of the polyester-based polyurethane foam may be compounded by hot and humid environments as well as using unapproved cleaning methods, such as ultraviolet (UV) light and ozone products. Philips plans on replacing the foam in first-generation devices’ after they receive the required regulatory clearances.
